1. GENERAL INFORMATION
1.1. Next Stop, AFRICA is an authorized re-seller of all products listed on this website.

1.2. Next Stop, AFRICA is operated by SMITBAR CC – closed corporation registration number CK2001/028788/23

1.3. Currency and merchant outlet country – transaction Currency is ZAR (South African Rand). The merchant outlet country at the time of presenting payment options to the cardholder is South Africa.

1.4. Legal Users may contact Next Stop, AFRICA by sending an e-mail to info@nsafrica.com or by using the contact form on the website. Users may also make contact by calling +27 81 819 0944/+27 21 035 0326 or sending a fax to +27 21 852 6499.

Next Stop, AFRICA may use all information submitted to further promote it and its partners’ websites and or services.

Next Stop, AFRICA may, in its sole discretion, change this agreement or any part thereof at any time without notice.

Next Stop, AFRICA chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 7 Private Road, Somerset West, 7130, South Africa.

1.5. Next Stop, AFRICA operates as a guide to enable users to find, book and pay for, accommodation and packaged tours. Next Stop, AFRICA thus acts as an advertising medium for these services and facilitates payments through the use of a payment gateway. However, the contract is based on an offer by the establishment which is accepted by the guest and therefore exists legally between these two parties. Next Stop, AFRICA’s responsibility with regard to any transaction is to assist both parties to agree on a booking, to receive payment from the guest for the required amount, to pass such payment to the establishment/operator after deducting agreed commission and to provide the guest with a reservation reference number, if applicable. The commission is only earned and brought to account once the client’s arrangements have been completed.
1.6. Next Stop, AFRICA is also responsible for providing support to users of the website by means of the contact form. In the event of a dispute between the guest and the establishment/operator, Next Stop, AFRICA will assist in resolving such dispute. Next Stop, AFRICA does not, however, underwrite or guarantee bookings between the guest and establishment/operator or the accuracy of the information portrayed by the establishment/operator or in its quote. In the event of any dispute between guest and establishment/operator, Next Stop, AFRICA will assist with the resolving of such disputes but is not liable to either party for any claims, damages or refunds of any type.

2. DISCLAIMER
2.1. All information and systems are the property of SMITBAR CC. Apart from the provisions of sections 43(5) and 43(6) of the Electronic Communications and Transactions Act, neither Next Stop, AFRICA nor any of its agents or representatives shall be liable for any damage, loss or liability of whatsoever nature arising from the use or inability to use this web site or the services or content provided from and through this web site. Furthermore, Next Stop, AFRICA makes no representations or warranties, implied or otherwise, that, amongst others, the content and technology available from this web site are free from errors or omissions or that the service will be uninterrupted and error free. 2.3. The establishment owner and/or operator agrees that guest comments can be published on the establishment listing by guests who have stayed at the establishment and further agrees that Next Stop, AFRICA is not liable or responsible in any way for the verification or accuracy of any guest comments made.

2.4. In terms of these standard trading conditions, and any contract /s concluded pursuant hereto, Next Stop, AFRICA acts as agent only for and on behalf of the client in procuring the services. As such, Next Stop, AFRICA shall procure the services for and behalf of the client as agent for it with relevant third party service providers concerned. Next Stop, AFRICA shall, under no circumstances, be liable for the acts and omissions of the relevant third party suppliers concerned.
2.5. Neither Next Stop, AFRICA nor any of its agents or representatives shall be liable for any damage, loss or liability of whatsoever nature arising from the use or inability to use any services sold by Next Stop, AFRICA.

3. PAYMENT METHODS
3.1. Credit Card Payments
Next Stop, AFRICA has all your transactions protected by powerful Secure Sockets Layer (SSL) encryption technology supported by Microsoft Internet Explorer and other popular browsers. SSL encrypts your all your personal information before it travels over the Internet. This makes doing online business just as secure as telephonic business. SSL safe connection and secure transaction technology has effectively protected thousands of our customers who have transmitted their credit card numbers online and made a purchase since we launched.

3.2. Once a client is ready to make payment for services, they will click the “pay now” button and be directed to our payment gate way host, www.paygate.co.za where they will fill in their credit card details in a secure system. Upon completing of payment, the client will be redirected to nsafrica.com

3.3. Payment is only collected when a quotation has been received from the establishment, while the quotation has not yet expired and when the guest accepts the quotation. Once payment has been made against a quotation, the offer and its acceptance become a binding contract. Following acceptance the establishment is required to send confirmation of the booking.

3.4. Customer details are separated from card details : No credit card details are stored on www.nsafrica.com

3.6. Such payments are required to be made at least 7 days before the expiry of a quotation, in order to allow sufficient time for the payment to clear the Next Stop, AFRICA bank account. The quotation (offer) is deemed accepted when the guest payment is received in Next Stop, AFRICA bank account within the validity period.

3.7. Clients must pay the exact amount and must place a reference number on the deposit slip.

4. DELIVERY & BOOKING PROCEDURE 
4.1. Clients of Next Stop, AFRICA place a booking enquiry. If the establishment has accommodation available during the required period a quotation is sent to the user. This constitutes an offer by the establishment, which can be accepted or declined. If the offer is accepted, it is only finalised when payment is made. The offer has an expiry date specified and is thus open for acceptance by the guest during the period prior to the expiry date. Acceptance by the guest prior to the offer expiring constitutes a binding contract between the establishment and the guest.

4.2. To secure your booking, payment is made either of the minimum 50% deposit required or the full amount. In certain circumstances the minimum deposit is equal to the full amount of the quotation.

4.3.  As soon as payment has cleared into the Next Stop, AFRICA bank account, delivery has taken place on the part of the guest and the establishment is required to confirm the reservation and a reservation confirmation reference number is issued. Delivery on the part of the establishment takes place when the guest has physically taken up the accommodation reserved.

4.4. Value added tax at 14% is charged by VAT registered establishments on bookings by South African residents.

5. CANCELLATION POLICY / REFUNDS AND RETURNS
5.1. All cancellations will only be accepted in writing.

5.2. Next Stop, AFRICA reserves the right to charge the following cancellation fees should a confirmed booking be cancelled. 

Next Stop, AFRICA payments (Applying to tenant or client): 
If the client does not arrive they forfeit 100% of the total payment received up till that point.
 If the client cancels 1 – 20 days before arrival then they forfeit 75% of the total payment received up till that point.
 If the client cancels 21 – 90 days before arrival then they forfeit 25% of the total payment received up till that point.

5.3. The Establishments/Suppliers/Affiliates may apply cancellation policies, which will be clearly displayed on every quotation. Cancellation policies will have implications for refunds according to certain time periods. 

5.4. Thus the relevant cancellation policies apply should you fail to join or start your tour/trip for any reason, including airline delays or missed connections or any other unforeseen circumstances. Please ensure you have adequate travel insurance for the purpose. You will become liable for cancellation penalties immediately on confirmation of your booking. 

5.5. Next Stop, AFRICA is not liable for incorrect rates specified on the web site and will not be obliged to supply bookings at those rates. The quotation supplied by the establishment is the responsibility of the establishment.

6. GOVERNING LAW / LEGAL JURISDICTION 
6.1. This site is managed, controlled and operated from the Republic of South Africa and is therefore governed by South African law.

6.2. Any and all Next Stop, AFRICA services and products are performable and/or sold in South Africa, and you irrevocably agree to that any cause of action you may submit will be filed in Cape Town, South Africa which will be the venue of any legal dispute. You also agree that any dispute will be governed by the laws of South Africa.

7. PRIVACY
7.1. Next Stop, AFRICA shall take all reasonable steps to protect the personal information of Users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). 8. SECURITY
8.1. Next Stop, AFRICA shall take all reasonable steps to protect the personal information of every user on the system and may store, notwithstanding other information, the following; name and surname, birth date, e-mail address, telephone numbers, cellular numbers, physical addresses, other personal information including surfing habits, IP addresses, username and passwords for the system booking and client preferences and any other information the user submits to this website. Next Stop, AFRICA only stores this information when a user has consented to these terms and conditions. Users are required, in every instance, to specifically indicate their consent before they are able to send an availability enquiry or a booking to an establishment.

8.2. Any person that delivers or attempts to deliver any damaging code to this web site or attempts to gain unauthorised access to any page on this web site shall be prosecuted and civil damages shall be claimed in the event that Next Stop, AFRICA suffers any damage or loss.

9. CHILD POLICY
9.1. Children of 12 years and older will be considered adults and be charged the appropriate rates.

9.2. Some establishments offer a discounted rate for children under the age of 12 years, though this will be advised depending on the supplier.

9.3. Depending on the supplier, children under the age of 12 may be unable to take part in certain activities, or even not allowed at the establishment. It is the responsibility of guests to confirm these details before confirming any bookings.

10. HEALTH/VACCINATION REQUIREMENTS

10.1. The guest must be aware of malaria, yellow fever, and other diseases, which are prevalent when traveling in Africa. All clients must consult with their own Medical Practitioner/Doctor, the Center for Disease Control or their national health authority regarding health/vaccination requirements prior to departure. The advice of a qualified, medical practitioner should be followed and Next Stop, AFRICA will accept no responsibility for inadequate medical or health requirements.

10.2. Guests should be medically fit and able to embark on any trips booked through Next Stop, Africa and its website. Any medical conditions need to be explicitly raised prior to travel, and the guest accepts responsibility for any necessary medicine or provisions.

11. VISA’S/PASSPORT REQUIREMENTS

11.1. It is the responsibility of the traveler to determine the nature of any travel documentation and the visas required for their travels, to ensure that all his/her travel documentation, including but not limited to passports, any necessary visas and medical certificates have been obtained and are in order prior to departure. Next Stop, AFRICA will not be held accountable for any costs incurred due to complications that may arise due to incomplete passport, visas or medical certificates.

12. MEDICAL AND TRAVEL INSURANCE 

12.1. All guests must have comprehensive travel, medical, cancellation, curtailment and default insurance for the duration of your trip. Due to the adventurous as well as remote and wild areas that tours sometimes take place in, it is vital that all guests are covered for emergencies and other unforeseen circumstances. Next Stop, AFRICA will not be held responsible for guests travelling without insurance. Please ensure you have adequate travel insurance for this purpose, prior to departure.

13. VARIATION OF THESE TERMS
13.1. No variation of these standard terms and conditions will be accepted unless present in a written document, signed by a member of Next Stop, AFRICA.
